At the Cougar Club luncheon today Dave Rose himself said that Davies came forward with the information, he did not get caught. I'll say it again, Davies turned himself in.

Thanks for the clarification.

Brandon's pregnant girlfriend turned herself in. What else could BYU do about that?

I head that she is pregnant as well, but I doubt that she turned herself in without Davies. From everything I've heard, Davies did the turning in.

But you're right, if she's pregnant, not much BYU can do about it.

According to SayWhat, Davies girlfriend is not pregnant.

There is a gap in this story. And since all we know publicly is a "how'd it happen" and "who'd it happen to" (at this point) version of "who done it". I really believe that Brandon didnt turn himself in.

If it is true that Franschmuck was going public with the info, I can imagine a call to Brandon saying "We need to meet, there is a 'report' coming out." And then Brandon, who fortunately has some mental and moral reasonability remaining, came forward with the information.

its called "plausible deniability" or a version of that, sort of a "plausible admissibility"--as in BYU claiming, "Brandon came forward with the info, The HC office didnt execute a thorough investigative interrogation (ie.,witch hunt) this time." I guess this is the "science" TH is referring to. Actually, it seems pretty reasonable as a methodology. How do we get the athlete to admit and "come forward" while still maintaining the HC code and not getting soiled with all the fan rage and accusations of poor handling. (BYU: "oh and if the guilty (i would say accused, but that implies due process) gets mud slung all over him, we'll hug him and say we love him of course bc we care for the sinner and partly bc he is about to get hit with a life-long label of having blown BYU's best bball season ever).

But, hey, "He came forward."

Guess I would probably do the same thing, particularly if he was maintaining two gf's and the one in Provo is pregnant--allegedly.

Here is my take (after re-emerging from my self-imposed silence and with a new name - used to be kitic77) on the situation:

There have been so many rumors that I don't think we truly know what happened, but here's what I think has happened. I think my scenario makes sense and fits most of the rumors.

I don't believe this was the first incident with Davies. Nor do I think a journalistic gun was aimed at BYU to come clean or else.

I think Davies had been working with his bishop on this issue. I think Brandon went to church on Sunday and spoke with his bishop to see how he was coming along. It was here that Brandon confessed that things were not progressing as they should have and that the immoral behavior had not stopped entirely.

At this point I think the bishop said that because of this, the issue should/could/would no longer remain between them and that Brandon should report the Honor Code violation. On Monday, in some order, Brandon turned himself to the HCO and spoke with Coach Rose and AD Holmoe.

When Rose and Holmoe learned that it was an on-going issue and had been referred to the HCO the decision him was made. Because this wasn't the first time this issue had been dealt with, I don't think BYU could do anything but suspend him. He knew what the rules were. He broke them. He was "working" on rectifying the situation with his bishop, but when that didn't appear to be working, the level of consequence was raised.

I think BYU was wrong to identify the nature of the suspension as being a result of the honor code. If your policy is you don't comment on honor code violations then don't comment on honor code violations. If you're just going to qualify the nature of the suspension by saying what it isn't you may as well just say what it is.

Since team rules likely (or should) include keeping/living the honor code, saying it was a violation of team rules is neither incorrect nor dishonest. This way you don't have to say it was for honor code reasons, but it wasn't criminal. Nor was it academic. You don't get kicked out for not shaving or wearing too short of shorts. Since there was no police record, it wasn't related to a DUI, so it probably wasn't alcohol related either. So pretty much all that's left is sexual impropriety.

BYU should have never qualified the nature of the violation. By saying what it wasn't they didn't leave much else to what it could be. A simply our only comment will be "that it was a violation of team rules" would suffice. You could even say, we will not entertain questions to the nature of the rule, if Brandon would like to disclose it he may.

Would everyone still think it was sex? Probably, but at least BYU wouldn't be the ones disclosing it by disclosing it wasn't everything else.

I think BYU handled the situation poorly. I think to a certain degree, they are holding BD up as an example of how much they hold to their standards. How unwavering BYU is to the honor code. They are, to a certain extent, exploiting him.

I think he has also inadvertently been branded with a scarlet letter for all intents and purposes. I think BYU needs a new and different spokesman. I don't know Carrie Jenkins but, to me, she has never seemed like a very understanding or compassionate person. She strikes me as a jaded individual who has worked too many honor code issues and no longer has much tolerance for violators. She has likely heard every plea and excuse. Witnessed too many tears to care, interviewed to many unrepentant students and dealt with way too many issues.

I hope the honor code office has frequent turnover with new blood coming into the office on a very regular basis. It's too easy and too important to leave to people who lose sight of what they are supposed to do, help those in violation of the code, not punish them. I think to a large degree, the HCO has a formula. If you do X you get Y. If you do G, you get H. I hope that's not the case, but I think it is.

I don't know if Brandon will be suspended from the university, but I bet he is for two semesters. I don't think he'll be back in a Cougar uniform until Nov 2012.

I think it's sad there wasn't away to delay the suspension. I think given the unique circumstances the entire team, coaching staff and fan base were facing. I don't think the HCO has been fair to any of them. We believe in being punished for our own sins and not for Adam's transgressions, yet it's tough to argue the team and staff (and even us fans) aren't being punished for Davies'.

I don't see why the punishment couldn't have been levied after the season. I think Brandon still would have felt remorse.

I think I'm finally ready to move on. I hope Brandon can recover from this. I wish him the best.

SpiffCoug--I think in your absence you have missed some of the details of what happened.

Carrie Jenkins doesn't work in the Honor Code office, and has never interviewed a single student about any violations and is not anyone a student would be giving excuses to. She is just the spokesperson for BYU as a whole, not just the Honor Code office, with one exception--the Athletic Department has it's own media relations wing.

Furthermore, the initial press release stating that Davies was done for the season because of an Honor Code violation didn't even come from her. That came from the Athletic Department.

It was not the university outing him for the HC violation. It was not the university or HC office that booted him from the team. All of that was done by the Athletic Department. All that Jenkins/the university have said is that he hasn't done anything criminal and we're not saying anything else until their own investigation is done with.

It was the Athletic Department who goofed this one, and I can understand Jenkins clarifying that he committed no crimes--in 98% of America, that is worse than premarital sex, so I can see them wanting to clear that up. The press would have figured that one out sooner or later anyway through public records.

I know that Jenkins isn't in the honor code office. But she pretty only ever speaks when it relates to athletes and honor code violations. And since you can't separate BYU from the honor code, she does in fact speak for the honor code office. She still strikes me as someone who has heard way too many excuses and is tired of them and no longer wants to hear any of them.

Right, there was no need to say it wasn't criminal because that would have become public record and have been discovered anyways.

I will grant it was the athletic department that screwed up the PR end. Having worked with the current bball SID, it's no surprise this was bungled. The current bball SID is still very young and inexperienced. I think he's in over his head.

I think when the kid responsible is 20 years old, it's much easier to shoot the messenger than it is to place blame where the blame actually lies.

As for me, I don't think that BYU did anything wrong or has anything to be ashamed of. Quite the opposite in fact. And I think in our day and age of widespread Cam Newton-ness, most national media members are refreshed by this story of actual punishment to fit actual violations.

The fact that Rose, Abouo, Holmoe, and even the fans have reached out so hard to try to keep Brandon in the fold has been an amazing story and the one that we can focus on the most at this point.
